Chapter 12 - The Custody Hearing

The emergency hearing took place four days later.
Vivian entered the courthouse wearing black.
Her expression was restrained.
Her attorney portrayed her as a grieving aunt desperate to protect her nephew.
Grace sat beside Adrian.
She wore no jewelry except her wedding ring.
Vivian’s attorney began with Grace’s legal status.
“She is not Leo’s biological mother.”
Grace did not react.
“She has no finalized adoption.”
Still nothing.
“She has repeatedly been present during dangerous incidents involving the child.”
Nathan stood.
“And in every documented incident, she protected the child.”
The judge looked over her glasses.
“Counsel, do you have evidence?”
Nathan placed the pool footage under seal.
The courtroom monitor came alive.
Vivian’s face changed.
She had already seen the recording.
What she did not know was what came after.
Marcus had synchronized two additional cameras.
One captured Vivian entering the equipment room.
Another captured her speaking on the phone.
The audio was imperfect.
But three words were unmistakable.
Camera is off.
Vivian stared at the screen.
Nathan stopped the video.
“The child fell into the pool approximately eleven minutes later.”
Vivian’s attorney rose.
“My client maintains that the contact was accidental.”
Nathan nodded.
“Then perhaps we discuss the stair gate.”
Photographs appeared.
Then the medication.
Then the nursery window.
Then the false landscaping order.
The judge’s expression changed with each item.
Vivian whispered furiously to her attorney.
Nathan continued.
“We also have a sworn declaration from Margaret Vale.”
Vivian turned.
Her mother sat in the rear of the courtroom.
Vivian’s face drained of color.
Margaret would not look at her.
Nathan summarized the guardianship amendment Elena had signed.
Then he produced Elena’s letter.
Vivian stood abruptly.
“That is private.”
The judge looked at her.
“Sit down, Ms. Vale.”
Vivian remained standing.
“That letter was written when Elena was unstable.”
Adrian turned toward her.
Again, Vivian knew too much.
The judge noticed.
Nathan asked, “How do you know what the letter contains?”
Vivian froze.
Her attorney pulled at her sleeve.
“Sit down.”
Vivian did.
Nathan approached the witness table.
“Mrs. Margaret Vale has sworn that Vivian took possession of this letter before Elena’s death and concealed it afterward.”
Vivian whispered, “Liar.”
Margaret began crying.
The judge called for order.
Two hours later, the ruling came.
Vivian’s request for custody was denied.
Her temporary guardianship rights were suspended.
The court prohibited unsupervised contact with Leo.
Grace’s adoption review would proceed.
Vivian sat motionless.
She had lost.
But as Adrian and Grace left the courtroom, Vivian spoke quietly behind them.
“You think Elena wanted Grace?”
Adrian stopped.
Grace touched his arm.
Vivian smiled.
“Elena never even knew her.”
Adrian turned.
Vivian’s eyes were cold.
“You can give Grace Elena’s house.”
“You can give her Elena’s ring.”
“You can even let Leo call her Mommy.”
Grace’s face tightened.
Vivian continued.
“But when he is old enough, I’ll tell him what really happened to his mother.”
Adrian stepped closer.
“What really happened?”
For the first time Vivian hesitated.
Then she smiled.
“Wouldn’t you like to know?”
Her attorney pulled her away.
Grace watched her disappear down the hallway.
“That wasn’t random.”
“No.”
“She wants you afraid.”
Adrian nodded.
But something in Vivian’s eyes had told him more.

And people who believed they were about to lose everything often made mistakes.
